These Terms of Service ("Terms") govern your access to and use of PublicAutoQuotes (the "Site"). By using the Site you agree to these Terms. If you do not agree, do not use the Site.
1. Eligibility
You must be at least 18 years old and a legal resident of the United States to use the Site or request a quote. By using the Site you represent that you meet these requirements.
2. Nature of our service
PublicAutoQuotes is a marketing and lead-referral service. We are not an insurance carrier, broker, or producer. We connect you with licensed insurance agents and underwriting carriers. Quotes are provided by those agents and carriers, who are responsible for setting prices, determining eligibility, issuing policies, and handling claims.
3. No insurance contract
Submitting a quote request through the Site does not bind insurance coverage and does not constitute an offer or agreement to issue insurance. Coverage begins only when you accept a written policy from a carrier and any required premium has been paid.
4. Accuracy of information
You agree to provide true, accurate, and complete information. We and our partners may rely on the information you submit when preparing quotes. Misrepresentations may result in quote denial, policy cancellation, claim denial, or other consequences with the carrier.
5. Communications consent
By submitting your information you expressly consent to be contacted byPublicAutoQuotes and our marketing partners using the contact information you provided, including by automated telephone dialing system, artificial or prerecorded voice, ringless voicemail, text/SMS, and email — even if your number is on a state or federal Do Not Call list. Consent is not a condition of purchase. Standard message and data rates may apply. You may opt out at any time by replying STOP, asking the caller to stop, or contacting info@publicautoquote.com.
6. Intellectual property
The Site and all content, branding, logos, and software are owned by PublicAutoQuotes or its licensors and are protected by intellectual property laws. You receive a limited, non-exclusive, revocable license to access the Site for personal, non-commercial use.
7. Prohibited conduct
- Submitting false, fraudulent, or third-party information.
- Scraping, copying, or reverse-engineering the Site.
- Interfering with the Site's security, integrity, or operation.
- Using the Site to violate any law or regulation.
8. Disclaimers
THE SITE AND ALL INFORMATION ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not guarantee that any specific quote, rate, or coverage will be available to you.
9. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, PUBLICAUTOQUOTES AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR DATA ARISING FROM YOUR USE OF THE SITE. OUR AGGREGATE LIABILITY SHALL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100).
10. Indemnification
You agree to indemnify and hold harmless PublicAutoQuotes from any claims, damages, or expenses (including reasonable attorneys' fees) arising from your use of the Site, your information, or your violation of these Terms.
11. Dispute resolution & arbitration
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS.
Any dispute arising out of or relating to these Terms or the Site will be resolved by binding individual arbitration administered by JAMS under its Streamlined Arbitration Rules, rather than in court, except that you may bring an individual claim in small-claims court if it qualifies. You and PublicAutoQuotes waive the right to a jury trial and to participate in any class, collective, or representative action. The arbitration will take place in Tarrant County, Texas, or by video conference.
12. Governing law
These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws principles, except that the Federal Arbitration Act governs Section 11.
13. Changes
We may update these Terms from time to time. Material changes will be posted on this page with a new "Last updated" date. Your continued use of the Site constitutes acceptance.
